Education Law - An Overview

Almost everyone has had some experience with public schools. Yet most have limited knowledge of public school law. In the past 30 years, the Federal Government has taken an increased role in determining the rights of those involved with public schools.

Special Education/Rights of Disabled Students

Students with disabilities have many protections through Federal legislation. The most recent is the 2004 reauthorization of the Individuals with Disabilities Education Act (IDEA).

There are many reasons why a student is not receiving the education he or she is entitled. Your child, or a child you know, may:

*not be appropriately identified as having a disability

*be identified under IDEA and have an Individual Education Plan (IEP), but not be receiving appropriate services

*unfairly have education terminated because of behaviors related to the disability

*be in a private school, and still be eligible for services provide by the local public school
